The incident took place around 10 p.m., Sunday, Sept. 8, in Bayville, said the Nassau County Police.

According to detectives, Johnathan Sunderland, 31, and Jennifer Garcia, 25, both of Bayville, attempted to confront their landlord at his residence. As they were knocking on his door, a woman, carrying her 1-year-old child started opening the door, police said.

That's when the duo allegedly pushed open the door, knocking the woman and her child to the ground. Sunderland charged the man inside the home and threw him to the ground.

Sunderland then got on top of the victim and began choking him as Garcia was kicking him in the face, police said.

Both then left the home and were followed outside by the woman, according to police. While in the driveway, Sunderland removed a pellet handgun from his waistband and fired four shots at the woman, missing her with all four shots, police said.

As police arrived both Sunderland and Garcia were arrested without further incident.

The man attacked was transported to an area hospital for treatment. The woman and her child were not injured.

Sunderland was charged with burglary, assault, menacing, criminal obstruction of breathing, and endangering the welfare of a child.

Garcia was charged with burglary, assault and endangering the welfare of a child.

Both defendants will be arraigned on Monday, Sept. 9, at First District Court in Hempstead.
